Data processing on this website is carried out by the website operator. Their contact details can be found in the "Information about the controller" section of this privacy policy.

How do we collect your data?

Some of your data is collected because you provide it to us. This may, for example, be data you enter into a contact form.

Other data is collected automatically, or with your consent, by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system, or time of the page view). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some data is collected to ensure the website is provided without errors. Other data may be used to analyse your user behaviour.

What rights do you have regarding your data?

You have the right at any time to obtain, free of charge, information about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time for the future. Furthermore, under certain circumstances you have the right to request that the processing of your personal data be restricted. You also have the right to lodge a complaint with the competent supervisory authority.

You may contact us at any time regarding this or any further questions on the subject of data protection.

Analytics tools and third-party tools

When you visit this website, your browsing behaviour may be statistically evaluated. This is done mainly using so-called analytics programs.

Detailed information about these analytics programs can be found in the following privacy policy.

2. Hosting

We host the content of our website with the following provider:

Austria Design

The provider is Austria Design, Pantzergasse 12, 1190 Vienna (hereinafter "AD"). When you visit our website, AD collects various log files including your IP address.

The use of AD is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable possible presentation of our website. Where consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and the Austrian Telecommunications Act (TKG) 2021, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. for device fingerprinting) within the meaning of the TKG 2021. Consent can be revoked at any time.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General information and mandatory disclosures

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

When you use this website, various personal data is collected. Personal data is data by which you could be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

Please note that data transmission over the internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.

Information about the controller

The controller responsible for data processing on this website is:

RHK Mobilenergy Solutions GmbH
Forchheimergasse 32
1230 Wien
Österreich

Phone: +43 1 869 4301
Email: office@rhk-mobilenergy.com

The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (such as names, email addresses, etc.).

Storage period

Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted, unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place once these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data are processed pursuant to Art. 9(1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing also takes place on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g. via device fingerprinting), data processing additionally takes place on the basis of the TKG 2021. Consent can be revoked at any time. If your data is required for the performance of a contract or the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data where this is necessary to fulfil a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Information on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not considered secure under data protection law. If these tools are active, your personal data may be transferred to and processed in these third countries. Please note that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are required to disclose personal data to security authorities without you, as the data subject, being able to take legal action against this. It therefore cannot be ruled out that US authorities (e.g. intelligence services) process, analyse and permanently store your data held on US servers for surveillance purposes. We have no influence over these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of data processing carried out before the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

Where data processing is carried out on the basis of Art. 6(1)(e) or (f) GDPR, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The specific legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims (objection pursuant to Art. 21(1) GDPR). Where your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for such marketing purposes; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection pursuant to Art. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work or place of the alleged breach. This right to complain exists without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Right to information, rectification and erasure

Within the scope of the applicable statutory provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of data processing, and, if applicable, a right to have this data corrected or deleted. You may contact us at any time regarding this or any further questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You may contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of the personal data we have stored, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent, or for the assertion, exercise or defence of legal claims, or to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the lock symbol in your browser bar.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our websites use so-called "cookies". Cookies are small data packages and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted after your visit ends. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services provided by third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.

Cookies that are necessary for carrying out the electronic communication process, for providing certain functions you desire (e.g. the shopping cart function), or for optimising the website (e.g. cookies to measure the web audience) ("necessary cookies") are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing takes place exclusively on the basis of this consent (Art. 6(1)(a) GDPR and TKG 2021); consent can be revoked at any time.

You can set your browser so that you are informed when cookies are set and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

You can find out which cookies and services are used on this website in this privacy policy.

Consent with Borlabs Cookie

Our website uses the consent technology of Borlabs Cookie to obtain your consent to the storage of certain cookies in your browser, or to the use of certain technologies, and to document this in a manner compliant with data protection law. The provider of this technology is Borlabs GmbH, Rübenkamp 32, 22305 Hamburg (hereinafter "Borlabs").

When you enter our website, a Borlabs cookie is stored in your browser, in which the consents you have given, or the revocation of these consents, are stored. This data is not passed on to the provider of Borlabs Cookie.

The data collected is stored until you ask us to delete it, you delete the Borlabs cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention periods remain unaffected. Details on Borlabs Cookie's data processing can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The Borlabs Cookie consent technology is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and version
  • operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – the server log files must be collected for this purpose.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR, provided your enquiry relates to the fulfilment of a contract or is necessary for carrying out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if this was requested; consent can be revoked at any time.

The data you enter in the contact form remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiry by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request.

The data you send to us via contact enquiries remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Analytics tools and advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that helps us integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, does not store cookies and does not carry out any independent analyses. It merely serves to manage and deliver the tools integrated through it. However, Google Tag Manager does collect your IP address, which may also be transmitted to Google's parent company in the United States.

The use of Google Tag Manager is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the fast and straightforward integration and management of various tools on its website. Where consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and the TKG 2021, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TKG 2021. Consent can be revoked at any time.

Google Analytics

This website uses features of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics allows the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, time spent on the site, operating systems used and the user's origin. This data is combined into a user ID and assigned to the respective device of the website visitor.

Furthermore, with Google Analytics we can, among other things, record your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the data sets collected and employs machine-learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and the TKG 2021. Consent can be revoked at any time.

Data transfer to the USA is based on the European Commission's standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

More information about how user data is handled by Google Analytics can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Data processing agreement

We have concluded a data processing agreement with Google and fully implement the strict requirements of the Austrian data protection authorities when using Google Analytics.

6. Plugins and tools

Google Fonts (local hosting)

This site uses so-called Google Fonts, provided by Google, for the uniform display of fonts. The Google Fonts are installed locally. No connection to Google's servers is established in the process.

Further information on Google Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy?hl=de.

Google Maps

To use the functions of Google Maps, it is necessary to store your IP address. This information is generally transmitted to a Google server in the USA and stored there. The provider of this site has no influence over this data transfer. If Google Maps is activated, Google may use Google Fonts for the uniform display of fonts. When Google Maps is called up, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

Google Maps is used in the interest of an appealing presentation of our online offerings and of making it easy to find the locations we indicate on the website. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is intended to check whether data input on this website (e.g. in a contact form) is made by a human or by an automated program. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the site. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, the time the website visitor spends on the site, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place.

The storage and analysis of the data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from spam.

YouTube with enhanced data protection

This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our pages on which YouTube is embedded, a connection to YouTube's servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in enhanced data protection mode. According to YouTube, videos played in enhanced data protection mode are not used to personalise browsing on YouTube. Ads shown in enhanced data protection mode are also not personalised. No cookies are set in enhanced data protection mode. Instead, however, so-called local storage elements are stored in the user's browser, which, similar to cookies, contain personal data and can be used for recognition purposes. Details on enhanced data protection mode can be found here: https://support.google.com/youtube/answer/171780.

Where applicable, further data processing operations may be triggered after activating a YouTube video, over which we have no influence.

YouTube is used in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified under the "EU-US Data Privacy Framework" (DPF).
